(a) The local unit may pay the reasonable funeral expenses of recipients of
aid to families with dependent children, general public assistance,
public assistance to adults, and on and after January 1, 1974 all
Maryland recipients of assistance payments from the federal
Supplemental Security Income Program under Title XVI of the Social
Security Act in an amount not to exceed:
(1) For the fiscal year commencing July 1, 1991, $735;
(2) For the fiscal year commencing July 1, 1992, $820; and
(3) For the fiscal year commencing July 1, 1993 and for each subsequent
fiscal year, $900.
(b) No payments for funeral expenses under this section may be provided by
the local unit unless every person legally responsible for the support
of the decedent is unable to pay the expenses, and other resources,
including available death benefits of the estate of the decedent, are
insufficient to pay the funeral expenses.
(c) Payments provided in accordance with this section shall be charged to
State funds.
