65-505 - FAILING OR REFUSING TO GIVE PREFERENCE -- CIVIL LIABILITY
All
elective officers, department heads, boards, commissions and all other public
officials in any state, county and municipal governments and departments, and
in all political subdivisions thereof, who deliberately or wilfully refuse or
fail to give preference to qualified war veterans required by the provisions
of this act shall be subject to writs of mandate pursuant to sections 7-301 to
7-314, Idaho Code, and if found in violation of any such provisions shall be
required to pay the costs of suit and reasonable attorney's fees incurred in
such action, and shall further be required to employ or reemploy the war
veteran, and shall be required to pay as damages such amount as the court may
award, but in no event shall the amount of such damages, costs of suit and
attorney's fees exceed the sum of two hundred fifty dollars ($250).
