Any person or persons who
operate a foster home, children's agency, children's therapeutic outdoor
program or children's residential care facility, within this state, without
first obtaining a license as provided in this chapter shall be guilty of a
misdemeanor. However, in the event of an initial citation for violation of the
provisions of this section, if a person makes the application required within
thirty (30) days, the complaint shall be dismissed. The penalty for violation
of the provisions of this section shall be three hundred dollars ($300) for
each day of a continuing violation, which penalty shall accrue from thirty
(30) days following the initial notice of violation in the event of a finding
of violation.
