There is hereby created
in the dedicated fund in the state treasury a forest practices rehabilitation
account, which shall be used by the department to rehabilitate forest lands
damaged by a forest practice that is not repaired following the serving of a
notice of violation. The department shall recover the costs of repairs and
reasonable administrative and legal fees in accordance with subsection (2)(e)
of section 38-1307, Idaho Code. Costs of repairs shall be deposited in the
forest practices rehabilitation account.
