33-3811 - ATTORNEY-GENERAL TO PASS ON VALIDITY OF BONDS -- INCONTESTABLE IF APPROVED
ATTORNEY GENERAL TO PASS ON VALIDITY OF BONDS -- INCONTESTABLE
IF APPROVED. Any institution may submit to the attorney general of the state
of Idaho any bonds to be issued hereunder after all proceedings for the
issuance of such bonds have been taken. Upon the submission of such
proceedings to the attorney general, it shall be the duty of the attorney
general to examine into and pass upon the validity of such bonds and the
regularity of all proceedings in connection therewith. If such proceedings
conform to the provisions of sections 33-3801--33-3813, and such bonds when
delivered and paid for will constitute binding and legal obligations of such
institution enforceable according to the terms thereof, the attorney general
shall certify in substance upon the back of each of said bonds that it is
issued in accordance with the Constitution and laws of the state of Idaho.
When delivered and paid for, any bond bearing upon its back such certificate
shall in any suit, action or proceeding involving its validity be conclusively
deemed to be fully authorized by sections 33-3801--33-3813 and to have been
issued, sold, executed and delivered in conformity with the Constitution and
laws of the state of Idaho and shall be deemed to be valid and binding and
enforceable in accordance with its terms, and such bonds shall be
incontestable for any cause.
