where the county commissioners, or the county executive and county
council, prior to September 1, 1971, shall determine to and in fact
shall implement or maintain at the county's expense a separate or
different system for providing counsel to indigent accused persons. Any

determination until such date as the Public Defender determines that it
is feasible to provide the county with services pursuant to this
article.
