46-1132 - FORMER JEOPARDY
(1) No person may be tried a second time in a
court-martial for the same offense.
(2) No person may be tried by court-martial for any offense if he has
been tried for substantially the same offense in any state court or in any
United States court.
(3) No proceeding in which an accused has been found guilty by a
court-martial upon any charge is a trial in the sense of this article until
the finding of guilty has become final after review of the case and all
available appeals have been fully completed.
