INITIATING RECALL PROCEEDINGS -- STATEMENT -- CONTENTS --
VERIFICATION -- DEFINITIONS. Whenever any legal voter of the irrigation
district, either individually or on behalf of an organization, desires to
demand the recall and discharge of a director of an irrigation district, under
the provisions of article VI, section 6, of the constitution of the state of
Idaho, he shall prepare a typewritten petition. The petition may recite that
the director has wilfully neglected or failed to perform faithfully a duty
imposed by law; or acted in an arbitrary and capricious manner; or has
committed an unlawful act; or has wrongfully acted so as to interfere with,
interrupt, or adversely affect the performance of his official duty; or has
violated his oath of office. The petition may describe the act or acts
complained of, if applicable, in concise language, give a detailed description
including the approximate date, location and nature of each act complained of,
be signed by the person making the charge, give his respective post office
address and be verified, under oath, that he believes the charge or charges to
be true and that he has knowledge of the alleged facts relating to the charges
if any have been alleged in the recall petition.
