41-228 - EXAMINATION EXPENSE
(1) Every insurer or corporation so examined
shall, at the direction of the director, pay the actual travel expenses,
reasonable living expense allowance, and compensation, at reasonable rates
customary for such examination and as approved by the director, necessarily
incurred on account of the examination, upon presentation of a detailed
account of such charges and expenses.
(2) No person shall pay and no examiner shall accept any additional
emolument on account of any examination.
(3) An insurer shall be entitled to offset against its premium taxes
payable to the department of insurance of the state of Idaho the examination
expense paid by it to or for the account of an examiner, actuary, or other
assistant designated by the director for the purpose of the examination,
inclusive of such personnel as may be so designated on behalf of other states
participating in any such examination. The offset, or any remaining portion
thereof, will be allowed for any of the five (5) calendar years following the
year in which such examination expense was paid.
