In any proceeding under this act for
the issuance or modification or repeal of rules relating to control of sources
of radiation, the agency shall comply with the requirements of chapter 52,
title 67, Idaho Code.
Notwithstanding any other provision of this act, whenever the agency finds
that an emergency exists requiring immediate action to protect the public
health, safety, or general welfare, the agency may, without notice or hearing,
issue a rule or order reciting the existence of such emergency and require
that such action be taken as is necessary to meet the emergency. Such rules or
orders shall be effective immediately.
