36-2116 - COMPLAINT FOR VIOLATION -- PROSECUTION BY COUNTY ATTORNEY
(a)
The board or its designated agent may prefer a complaint before any court of
competent jurisdiction in the county where the offense occurred, for a
violation of: (i) the provisions of subsections (1), (2), (7), (8), or (9) of
section 36-2113, Idaho Code; or (ii) any regulation promulgated pursuant to
subsection (d) of section 36-2107, Idaho Code.
(b) Any person convicted of any violation enumerated in subsection (a) of
section 36-2116, Idaho Code, shall be guilty of a misdemeanor and upon
conviction thereof, shall be punished as provided in section 36-2117, Idaho
Code. Fifty percent (50%) of all fines and forfeitures collected shall be paid
to the outfitters and guides board and such moneys so received by the board
shall be deposited with the state treasurer and the state treasurer shall
credit the same to the Idaho outfitters and guides board account and fifty
percent (50%) of all fines and forfeitures collected shall be distributed in
accordance with section 19-4705, Idaho Code.
