25-2720 - INSPECTION FEES
a. There shall be paid to the department of
agriculture for all commercial feeds distributed in this state, an inspection
fee at the rate of not more than twenty cents (20¢) per ton, by the registrant
except that a person other than the registrant may assume liability for the
inspection fee. Fees so collected shall be paid into the state treasury and
placed in the "Commercial Feed and Fertilizer Fund" and shall be used to pay
the costs of inspection, sampling, analysis, and other expenses necessary for
the administration of this chapter. Payment of inspection fees is subject to
the following:
1. No fee shall be paid on a commercial feed if the payment has been made
by a previous distributor.
2. No fee shall be paid on customer-formula feeds if the inspection fee
is paid on the commercial feeds which are used as ingredients therein.
3. No fee shall be paid on commercial feeds which are used as ingredients
for the manufacture of commercial feeds which are registered. If the fee
has already been paid, credit shall be given for such payment.
4. Sales of commercial feeds to manufacturers or exchanges between them
are hereby exempted if the commercial feeds so sold or exchanged are used
solely in the manufacture of feeds which are registered.
5. In the case of a commercial feed which is distributed in the state in
packages of ten (10) pounds or less, an annual registration fee of
twenty-five dollars ($25.00) per product shall be paid in lieu of an
inspection fee.
6. The minimum inspection fee shall be five dollars ($5.00) per quarter.
b. Payment of the inspection fee shall be evidenced by a statement made
under oath in due form of law, of commercial feed distributed together with
documents showing that fees corresponding to the tonnage were received by the
director. Every person required to register in accordance with section
25-2718, Idaho Code, shall:
1. File, not later than the last day of January, April, July, October of
each year, a quarterly statement under oath, setting forth the number of
net tons of commercial feeds distributed in this state during the
preceding three (3) month period; and upon filing such statement shall pay
the inspection fee at the rate stated in paragraph a of this section.
2. Keep such records as may be necessary or required by the director to
indicate accurately the tonnage of commercial feed distributed in this
state and the director shall have the right to examine such records to
verify statements of tonnage.
3. Inspection fees which are due and owing and have not been remitted to
the department within thirty (30) days following the due date shall have a
late collection fee of ten percent (10%), but not less than twenty-five
dollars ($25.00), added to the amount due when payment is finally made.
The assessment of this late collection fee shall not prevent the director
from taking any other action as provided for in this chapter.
Failure to make an accurate statement of tonnage or to pay the inspection
fee or comply as provided herein shall constitute sufficient cause for the
cancellation of all registrations on file for the distributor.
