All beef cattle animal feeding operations operating
in compliance with this act and approved best management practices shall not
be subject to state enforcement action due to violations of state water
quality standards or state ground water quality standards except in the event
of imminent and substantial danger as provided in chapter 1, title 39, Idaho
Code. However, the department shall evaluate and modify such best management
practices as necessary.
