The department shall administer, enforce, and
carry out the provisions of this chapter and may adopt rules necessary to
carry out its purposes including, but not limited to, the proper use,
handling, transportation, storage, display, distribution, sampling, records,
analysis, form, minimum percentages, fertilizer ingredients, exempted
materials, investigational allowances, definitions, labels, labeling,
misbranding, mislabeling and disposal of fertilizers and their containers. The
adoption of rules is subject to public hearing as prescribed by the Idaho
administrative procedure act, chapter 52, title 67, Idaho Code. |
