14-115 - PROCEEDINGS AGAINST PUBLIC ADMINISTRATOR
When it appears that
any money remains in the hands of the public administrator (after a final
settlement of the estate) unclaimed, which should be paid over to the state
tax commission the judge must order the same to be paid over, and on failure
of the public administrator to comply with the order within ten (10) days
after the same is made, the prosecuting attorney for the county must
immediately institute the requisite legal proceedings against the public
administrator for a judgment against him and the sureties on his official
bond, in the amount of money so withheld, and costs.
